Liability and Limitation Thereof

  1. Participation in the Session is at one’s own responsibility.

  2. Resolve Collective and the Facilitators involved in the Session are not liable for indirect or consequential damages, including loss of profit, missed savings, reputational damage, or lost opportunities.

  3. To the extent that Resolve Collective or the Facilitators are liable for damages, such liability for direct damages is limited to a maximum of the amount paid by the participant for the relevant Session.

  4. The limitations of liability set out in this article do not apply:
    a. where exclusion or limitation of liability is not permitted under mandatory law, including liability for death or personal injury;
    b. in cases of intent or gross negligence by Resolve Collective or the Facilitators.

  5. If damage is partly the result of incorrect, incomplete, or untimely information provided by the participant, including information about contraindications, medication use, or other relevant circumstances, liability shall be reduced to the extent that such circumstances contributed to the damage.

  6. The participant indemnifies Resolve Collective only against third-party claims insofar as such claims result from intentional or recklessly negligent actions by the participant and are not also the result of acts or omissions by Resolve Collective or the Facilitators.

Privacy and Data Processing

Participation requires the processing of personal data, including health data.

  1. For the performance of the agreement, Resolve Collective processes personal data such as name, contact details, booking and payment details, and communication related to the session. This processing is necessary for the execution of the agreement and/or to take steps at the participant’s request prior to entering into the agreement.

  2. For safe and responsible participation, it may be necessary for Resolve Collective to process special categories of personal data, including health data such as information about contraindications, medication use, and relevant physical or psychological conditions.

  3. For the processing referred to in section 2, I give explicit consent solely for the following purposes:
    a. assessing suitability for participation (screening);
    b. ensuring safety during the Session;
    c. responding to and handling questions or incidents directly related to my participation.

  4. I declare that I have received and read the Resolve Collective privacy policy prior to participation. I have been informed of my rights, including the right of access, rectification, erasure, restriction of processing, and the right to lodge a complaint with the Data Protection Authority.

  5. I may withdraw my consent for the processing of health data at any time. Withdrawal does not affect the lawfulness of processing prior to withdrawal and may result in participation (or continuation thereof) no longer being possible, as safe execution can no longer be guaranteed.

  6. Where necessary for compliance with legal obligations or for handling complaints, incidents, or disputes, Resolve Collective may process and retain personal data within the applicable legal frameworks.
